1. Acceptance of Terms
By accessing or using any services provided by Muaklek Cloud ('Company', 'we', 'us'), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not use our services. These Terms form a legally binding agreement between you and Muaklek Cloud.
2. Services Description
Muaklek Cloud provides professional technology services including software development, cloud infrastructure, cloud server hosting, and IT consulting. The specific scope, deliverables, timelines, and pricing are defined in individual service agreements or quotations. We reserve the right to modify or discontinue any service at any time with reasonable notice.
3. User Accounts
To access certain services, you may be required to register an account. You are solely responsible for maintaining the confidentiality of your credentials and for all activities conducted under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Payment & Billing
All payments are processed securely through Stripe. By providing payment details, you authorize Muaklek Cloud to charge applicable fees as stated in your service agreement or invoice. All prices are in US Dollars (USD) unless otherwise specified. Unpaid invoices may result in service suspension. We reserve the right to adjust pricing with prior notice.
5. No Refund Policy
All payments to Muaklek Cloud are final and non-refundable. We do not offer refunds, credits, or exchanges for any reason, including partially completed projects, consulting hours, subscription fees, or cloud usage charges. If you have concerns regarding a charge, please contact our support team. We will review each case in good faith, but this does not obligate us to issue any refund.
6. Intellectual Property
All content, code, designs, documentation, and materials created by Muaklek Cloud are our intellectual property unless otherwise agreed in writing. Upon full payment, clients receive a license to use deliverables as specified in the service agreement. Unauthorized reproduction, distribution, or modification of our materials is strictly prohibited.
7. Prohibited Use
You agree not to misuse our services. Prohibited activities include: unauthorized access to our systems, distributing malware or illegal content, violating applicable laws, infringing on intellectual property rights, engaging in fraudulent transactions, or attempting to reverse engineer our software. Violations may result in immediate account termination and legal action.
8. Limitation of Liability
Our services are provided 'as is' without warranties of any kind. To the fullest extent permitted by law, Muaklek Cloud shall not be liable for any indirect, incidental, or consequential damages, including loss of profit, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the three (3) months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from these Terms or use of our services shall be subject to the exclusive jurisdiction of Thai courts. We encourage resolving disputes amicably through direct communication before initiating formal legal proceedings.
10. International Users & Compliance
Our services are available to users worldwide. By using our services, you represent that you are not located in a country subject to international trade sanctions or embargoes (including those imposed by the UN, US, EU, or Thailand). You are solely responsible for ensuring that your use of our services complies with all applicable laws in your jurisdiction, including export controls, data protection regulations, and consumer protection laws. Prices are displayed in US Dollars (USD); your bank or Stripe may apply currency conversion fees. We reserve the right to restrict or terminate access in certain countries or regions at our sole discretion.
